APRIL 13, 1996, did violate HORSE RACING ALBERTA Rule 460; Drivers shall keep both feet in the stirrups during the post parade, while in front of the grandstand, and from the time the horses are brought to the starting gate until the race has been completed. FEBRUARY 8, 1957, did violate HORSE RACING ALBERTA Rule 123(1); Any person responsible for a horse stabled at a Horse Racing Alberta licensed race track must provide proof of a negative Equine Infectious Anemia (Coggins test). The test must be dated within the past 12 months (365 days) and submitted at least 48 hours before admittance to the race track. Proof of the negative test must be reported to Horse Racing Alberta Security. Having heard the appeal of OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, DAVID ADAM KELLY, PERM. ADD.: WHEATLAND COUNTY, ALBERTA, CANADA, D.O.B. OCTOBER 11, 1989, regarding HORSE RACING ALBERTA Ruling #57 dated August 24, 2024, whereas the penalty granted is a suspension of thirty (30) calendar days (driving only), August 26 to September 24, 2024 (inclusive).
The Appeal Tribunal has amended the thirty (30) day driving suspension imposed on Mr. Kelly and has hereby reduced the penalty to a ten (10) calendar day driving suspension from June 26 to July 5, 2025 (inclusive). In the event that any race days within that time frame are cancelled and HORSE RACING ALBERTA makes up races, the suspension shall apply to the make up days.
