In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, PHILIP SYLVIO GIESBRECHT, PERM. ADD.: FORT SASKATCHEWAN, ALBERTA, CANADA, D.O.B. DECEMBER 23, 1988, did violate HORSE RACING ALBERTA Rule 460; Drivers shall keep both feet in the stirrups during the post parade, while in front of the grandstand, and from the time the horses are brought to the starting gate until the race has been completed. Drivers shall be permitted to remove a foot from the stirrups during the course of the race solely for the purpose of pulling ear plugs and once these have been pulled, the foot must be placed back into the stirrup. If a driver’s foot is in or out of the stirrup, he or she shall not allow his/her foot to hit a horse in any manner; while driving #1 “ELECTRIC AMADEUS” in Race 6, Friday, July 17, 2026. (Foot out of stirrup contacting horse.)

PENALTY: PHILIP GIESBRECHT is hereby FINED THE SUM OF ONE HUNDRED DOLLARS ($100.00).

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten (10) days.

MEETING: Century Mile Racetrack & Casino, Alberta, Canada - July 17, 2026

WHEREAS OWNER/TRAINER, FARRIER/PLATER, AUTHORIZED AGENT, BRENT FRANK BODOR, PERM. ADD.: CALGARY, ALBERTA, CANADA, D.O.B. JUNE 3, 1968, did violate HORSE RACING ALBERTA Rule 300(1)(c) on November 29, 2025, resulting in the Board of Judges issuing Harness Ruling #125-2025 on December 6, 2025, which resulted in a fine of THREE HUNDRED AND FIFTY DOLLARS ($350.00), SUSPENSION AND DENIAL OF THE PRIVILEGES OF THE GROUNDS (INCLUDING GRANDSTAND) OF ALL RACETRACKS IN ALBERTA THAT COME UNDER THE SUPERVISION OF HORSE RACING ALBERTA FOR A PERIOD OF THIRTY (30) CALENDAR DAYS, which was partially stayed on December 12, 2025 by the HORSE RACING APPEAL TRIBUNAL (“HRAT”) and which Mr. Bodor appealed to HRAT;

AND WHEREAS MR. BODOR did violate HORSE RACING ALBERTA Rule 300(1)(c) on December 4, 2025, resulting in the Board of Judges issuing Harness Ruling #4-2026 on January 15, 2026, which resulted in a fine of THREE HUNDRED AND FIFTY DOLLARS ($350.00), AN INITIAL SUSPENSION AND DENIAL OF THE PRIVILEGES OF THE GROUNDS (INCLUDING GRANDSTAND) OF ALL RACETRACKS IN ALBERTA THAT COME UNDER THE SUPERVISION OF HORSE RACING ALBERTA FOR A PERIOD OF THIRTY (30) CALENDAR DAYS, the right to increase following the determination of the appeal of Harness Ruling #125-2025, which was partially stayed by HRAT on January 23, 2026, permitting Mr. Bodor to access public areas of racetracks, and which Mr. Bodor appealed;

AND WHEREAS Mr. Bodor did violate  Rule 286(a) by conducting himself in a manner prejudicial to the best interest of horse racing by for performing duties as a trainer while under suspension pursuant to Harness Ruling #4-2026, resulting in a fine of TWO THOUSAND, FIVE HUNDRED DOLLARS ($2,500.00), SUSPENSION AND DENIAL OF THE PRIVILEGES OF THE GROUNDS (INCLUDING GRANDSTAND) OF ALL RACETRACKS IN ALBERTA THAT COME UNDER THE SUPERVISION OF HORSE RACING ALBERTA FOR A PERIOD OF SIXTY (60) CALENDAR DAYS, FEBRUARY 15 — APRIL 15, 2026 (INCLUSIVE), which was stayed by HRAT on February 28, 2026, and which Mr. Bodor appealed;

AND WHEREAS the hearing of the appeals of the three (3) Harness Rulings was set for July 13-15, 2026;

AND WHEREAS MR. BODOR applied to HRAT to determine whether Horse Racing Alberta Rule 300 (“Prohibited blood/alcohol concentrations”) is an Absolute Liability offence, meaning that intention or due diligence are irrelevant to the determination of liability;

AND WHEREAS on May 15, 2026, HRAT informed the parties that it had ruled that Rule 300 is an Absolute Liability offence, with reasons for that conclusion to be provided in conjunction with its written reasons for decision on the merits of these appeals; 

AND WHEREAS Mr. Bodor now accepts the findings of the screening test and confirmation tests resulting in Harness Rulings #125-2025 and #4-2026 but states he did not intend to ingest cocaine on the occasions leading up to these rulings;

AND WHEREAS DESPITE THE VARIOUS STAYS of the Rulings as set out here, Mr. Bodor has voluntarily refrained from engaging in racing, essentially abiding by the suspensions set out in them, for some FIVE (5) MONTHS;

AND WHEREAS MR. BODOR on December 3, 2025 requested the saliva swab from the November 29, 2025test be made available to MR. BODOR (for re-testing for metabolites);

AND WHEREAS Horse Racing Alberta requested the saliva swabs (from the November 29, 2025 test and from the December 4, 2025 test) be re-tested;

AND WHEREAS MR. BODOR, through legal counsel and as directed by HRAT, first requested in June 2026 that any residual saliva sample from the confirming laboratory (which had quantitatively confirmed the two positive tests) or from the re-testing laboratory (which had qualitatively confirmed the two positive tests) and be provided for quantitative re-test, only to be informed that residue was no longer available for retesting for quantitative levels;

IT IS AGREED AND ACCEPTED BY THE PARTIES THAT:

1. Mr. Bodor will be suspended until and including December 31, 2026, during which time he shall not be permitted to engage in any licensed role including as owner, trainer, farrier/plater or authorized agent, at any racetrack in Alberta that comes under the supervision of Horse Racing Alberta; or attend at any racetrack in Alberta that comes under the supervision of Horse Racing Alberta, other than as a spectator in the grandstand only (not the Winner’s Circle).  For greater certainty, Mr. Bodor may train horses he owns at a location other than at a racetrack in Alberta that comes under the supervision of Horse Racing Alberta, may conduct farrier/plater duties on horses at any location other than at a racetrack in Alberta that comes under the supervision of Horse Racing Alberta and may ship horses to and from any location other than a racetrack in Alberta that comes under the supervision of Horse Racing Alberta.     
2. Mr. Bodor will pay the outstanding fine of TWO THOUSAND, FIVE HUNDRED DOLLARS ($2,500.00) on a reasonable payment plan determined by Horse Racing Alberta, being eight (8) equal monthly payments commencing October 1, 2026.
3. Prior to being granted a license to participate in horseracing in any form in 2027, Mr. Bodor will be required to provide a negative sample as determined through Horse Racing Alberta’s usual testing methods as set out in its Drug and Alcohol Policy and in Horse Racing Alberta’s Rule 300.

MEETING: Century Downs Racetrack and Casino, Balzac, Alberta, Canada - July 15, 2026

In the opinion of the Board of Judges, DRIVER, WINSTON DREW CAMPBELL, CALGARY ALBERTA, CANADA, D.O.B. JULY 4, 1967, did violate HORSE RACING ALBERTA Rule 344;  No person may smoke on the property of a licensed operator except in designated areas;  by smoking in an undesignated area on Thursday, July 9, 2026.

PENALTY:  WINSTON DREW CAMPBELL is hereby FINED THE SUM OF ONE HUNDRED DOLLARS $100.00.  (First Offence.)

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten (10) days.

MEETING: Evergreen Park, Grande Prairie, Alberta, Canada - July 12, 2026

JOCKEY, ORLANDO FOSTER, PERM. ADD.: ST. CATHERINE, JAMAICA, D.O.B. MARCH 27, 1991, is hereby FINED THE SUM OF TWO HUNDRED DOLLARS ($200.00) for allowing his mount #2 “OOPS” to come out during the run, coming out of the last turn and into the stretch interfering with #5 “ADVENTUROUS” on his outside thereby causing #2 “OOPS” to be DISQUALIFIED from 4th and placed 5th in Race 3, Saturday, July 11, 2026.
